Declaration of the Designated Area under section 10D (1) of the Control of Weapons Act 1990

The public place area depicted on the map below has been declared to be a Designated Area under section 10D (1) of the Control of Weapons Act 1990 (the Act).

This declaration will be in place on 8 April 2025 between the times of 9am and 9pm.

Police powers under the Designated Area

Please be advised that:

  • A declaration is in force pursuant to section 10D of the Control of Weapons Act 1990 (planned designation).
  • Police officers and protective services officers on duty at a designated place (as per the Victoria Police Act 2013) are empowered to search you and anything in your possession or under your control and/or vehicle and anything on or in the vehicle.
  • It is an offence to obstruct or hinder a police officer or a protective services officer on duty at a designated place in the exercise of a power to stop and search a person or a vehicle.

If a police officer or protective services officer on duty within a designated place intends to conduct a limited search of you or your vehicle/things for weapons:

  • You are requested to co-operate with that search.
  • You may be requested to remove items of outer clothing such as headwear, scarves, jackets, etc.
  • You may be searched using an electronic wand.
  • You may be requested to remove items from any bags or pockets.
  • You may be given a “pat down” search.

Whilst within the designated area, a police officer may request that you remove any face covering if the police officer reasonably believes the face covering is being worn primarily to conceal your identity, or to protect from the effects of crowd-controlling substances. If you refuse to remove the face covering, the police officer may direct you to leave the designated area.

A police officer may also direct a person to leave a designated area if the police officer reasonably believes the person intends to engage in conduct that would constitute an offence under section 195H (affray) or 195I (violent disorder) of the Crimes Act 1958.

It is an offence to fail to comply with any direction to leave a designated area without reasonable excuse.

Boundary of the Designated Area

All public places within the City of Port Phillip that are within the area bounded by and including Bay Street, Port Melbourne from the intersection of Rouse Street, Port Melbourne to the intersection of Bridge Street, Port Melbourne.

Street has the same meaning as per section 3 of the Road Safety Act 1986.
